📌Personal use● ผลงานที่เข้าข่ายการนำไปใช้งานส่วนตัวมีดังนี้            ○ ไฟล์ภาพสำหรับเป็นของขวัญให้ผู้อื่น
            ○ ของแจกที่ไม่ใช่การโปรโมทผลงาน เช่น ของแจกงานคอนเสิร์ต หรือ Fancafe
            ○ ผลงานที่ถูกนำไปผลิตเป็นสิ่งของที่เก็บไว้เอง ไม่ขายสร้างกำไร เช่น พวงกุญแจ สแตนดี้อะคริลิค● ผู้ว่าจ้างสามารถนำไปทำซ้ำ ดัดแปลงได้โดยไม่นำไปใช้ในเชิงพาณิชย์เพื่อสร้างกำไร เช่น ใส่ Font บนรูปเพิ่มเติมเพื่อปริ๊นโปสการ์ดเป็นของขวัญให้คนรู้จัก● กรณีที่ผู้ว่าจ้างไม่ต้องการให้นำภาพไปเป็นตัวอย่างงาน สามารถแจ้งก่อนเริ่มงานได้● ผู้ว่าจ้างไม่จำเป็นต้องให้เครดิตนักวาดทุกครั้งที่อัพโหลดงานลงพื้นที่สาธารณะ
แต่ห้ามแอบอ้างว่าเป็นผลงานที่ผู้ว่าจ้างหรือบุคคลอื่นวาดเองทั้งนี้ ลิขสิทธิ์ตัวภาพยังเป็นของนักวาด ผู้ว่าจ้างไม่สามารถนำไปใช้ในเชิงพาณิชย์ได้จนกว่าจะชำระเงินเพิ่มเติมเพื่อซื้อขาด

📌Commercial use● ผลงานที่เข้าข่ายการนำไปใช้เชิงพาณิชย์มีดังนี้            ○ ภาพประกอบเพื่อโปรโมทผลงานบนแพลตฟอร์มออนไลน์หรือออฟไลน์ ไม่ว่าจะเกิดรายได้หรือไม่ นับเป็นเชิงพาณิชย์ทั้งหมด เช่น ปกนิยายหรือแฟนฟิคออนไลน์, ปกนิยายหรือแฟนฟิครูปเล่มตีพิมพ์, แฟนอาร์ตให้ Vtuber, ภาพโปรโมทหรือของแถมโปรโมท Fancafe(กรณีเป็นผู้จัดงานมาว่าจ้าง), ภาพตัวละครหรืออื่น ๆ ที่เกี่ยวข้องกับผลงานของผู้ว่าจ้าง (กรณีอื่น ๆสามารสอบถามนักวาดเพิ่มเติมได้)
            ○ ของแจกเพื่อโปรโมทผลงานบนแพลตฟอร์มออนไลน์หรือออฟไลน์
            ○ ผลงานที่ถูกนำไปผลิตเป็นสินค้าขายสร้างกำไรโดยตรง เช่น พวงกุญแจ สแตนดี้อะคริลิค● ผู้ว่าจ้างต้องแจ้งการนำไปใช้งานให้ละเอียดทุกครั้งก่อนตกลงราคากับนักวาด หากพบภายหลังว่าผลงานถูกนำไปใช้เชิงพาณิชย์ ผู้ว่าจ้างจะต้องชำระเงินค่าส่วนต่างเพิ่มตามเรทราคาเชิงพาณิชย์ที่นักวาดกำหนดไว้● ผู้ว่าจ้างสามารถนำภาพไปทำซ้ำ ดัดแปลงในเชิงพาณิชย์เพื่อสร้างกำไรได้● กรณีที่ว่าจ้างเพื่อนำภาพไปทำปกนิยาย แต่ต้องการทำสินค้าจากไฟล์ภาพเดิมแถมไปกับรูปเล่มด้วย จะไม่มีค่าใช้จ่ายเพิ่มเติม● กรณีที่ว่าจ้างเพื่อนำภาพไปทำปกนิยาย แต่ต้องการขายสินค้าเพิ่มเติมจากไฟล์ภาพนั้นด้วย ผู้ว่าจ้างจะต้องชำระค่าใช้จ่ายเพิ่มเติมสินค้าละ 80% ของราคาไฟล์ภาพนั้น เช่น ราคาปกนิยาย 5000 บาท ต้องการนำภาพไปทำสแตนดี้อะคริลิค (5000 × 80% = 4000) และ พวงกุญแจ(5000 × 80% = 4000)เพื่อขายด้วย ดังนั้นราคาที่ต้องชำระเพิ่มคือ 4000 + 4000 = 8000 บาท● ผู้ว่าจ้างไม่จำเป็นต้องให้เครดิตนักวาดทุกครั้งที่อัพโหลดงานลงพื้นที่สาธารณะ แต่ห้ามแอบอ้างว่าเป็นผลงานที่ผู้ว่าจ้างวาดเองทั้งนี้ ลิขสิทธิ์ตัวภาพจะตกเป็นของผู้ว่าจ้าง โดยนักวาดสามารถนำผลงานไปเป็นตัวอย่างคอมมิชชั่นได้ก็ต่อเมื่อผู้ว่าจ้างอนุญาตเท่านั้น


*หากมีกรณีนอกเหนือจากนี้ สามารถพูดคุยตกลงกับนักวาดเพิ่มเติมได้ทันทีเพื่อความชัดเจนค่ะ

📃หมวดจองคิว● ผู้ว่าจ้างสามารถจองได้มากที่สุด 2 คิวต่อเนื่องกัน (1 คิว ต่อ 1 บรีฟเท่านั้น)
● เมื่อนักวาดส่ง Email ข้อมูลวันที่เริ่มงาน ราคา และกำหนดชำระเงินให้ หลังจากผู้ว่าจ้างกรอกฟอร์มบรีฟแล้ว ผู้ว่าจ้างสามารถขอปรับเปลี่ยน บรีฟ และ/หรือ วันที่เริ่มงานได้ นักวาดจะเสนอตารางเวลา และ/หรือ ราคาสำหรับบรีฟใหม่ให้จนกว่าจะได้ข้อตกลงที่สะดวกทั้งสองฝ่าย
● หากไม่มีการตอบกลับ Email จากผู้ว่าจ้างภายใน 5 วัน จะถือว่าขอยกเลิกจองคิว โดยนักวาดไม่ต้องแจ้งให้ทราบล่วงหน้า

📝หมวดเริ่มงาน● ผู้ว่าจ้างต้องชำระเงินก่อนเริ่มงานตามวันที่กำหนด มิฉะนั้นจะถือว่าขอยกเลิกคิวโดยนักวาดไม่ต้องแจ้งให้ทราบล่วงหน้า สามารถชำระเป็นมัดจำตามที่ตกลงกันไว้ หรือ ชำระเต็มจำนวนได้ แล้วแต่สะดวก
● หากผู้ว่าจ้างต้องการเปลี่ยนบรีฟทั้งหมดระหว่างรอคิว ควรส่งบรีฟใหม่ให้นักวาดล่วงหน้าอย่างน้อย 2 อาทิตย์ก่อนวันเริ่มงานที่กำหนด เพื่อให้นักวาดคำนวณราคาใหม่ (กำหนดวันที่ชำระเงินเดิม)
● หากผู้ว่าจ้างต้องการเลื่อนคิวหรือวันเริ่มงาน ต้องแจ้งนักวาดล่วงหน้าอย่างน้อย 2 อาทิตย์ก่อนวันเริ่มงานเดิมที่กำหนด เพื่อหาวันที่เริ่มงานใหม่ที่เหมาะสม

📝หมวดแก้งาน● ในขั้นตอนร่าง ผู้ว่าจ้างสามารถขอแก้ไขงานได้ฟรี 3 ครั้ง ต่อจากนั้นคิดเพิ่มครั้งละ 100 บาท (ชำระเพิ่มก่อนรับไฟล์จริง)
● ในขั้นตอนตัดเส้น และ/หรือ ลงสี ผู้ว่าจ้างสามารถขอแก้ไขงานได้ฟรี 3 ครั้ง ต่อจากนั้นคิดเพิ่มครั้งละ 100 บาท (ชำระเพิ่มก่อนรับไฟล์จริง)
● หากมีการแก้ไขหรือเปลี่ยนแปลงองค์ประกอบในงานที่กระทบราคาที่ตกลงในตอนแรก จะคิดค่าใช้จ่ายเพิ่มเติมตามความเหมาะสม (ชำระเพิ่มก่อนรับไฟล์จริง)
● กรณีเป็นความผิดพลาดของนักวาด เช่น อ่านบรีฟตกหล่น นักวาดจะแก้ไขให้ฟรีในครั้งนั้น

❌หมวดยกเลิกงาน● ผู้ว่าจ้างสามารถขอยกเลิกคิวล่วงหน้าอย่างน้อย 2 อาทิตย์ก่อนวันเริ่มงานได้ โดยไม่เสียค่าใช้จ่ายใด ๆ
● หากผู้ว่าจ้างต้องการยกเลิกคิวเมื่อเหลือเวลาน้อยกว่า 2 อาทิตย์ก่อนวันเริ่มงาน ผู้ว่าจ้างต้องชำระค่ายกเลิกคิวเป็นจำนวนเงิน 10% ของราคางานนั้น ๆ
● หากมีการขอเลื่อนคิว หรือ ขอยกเลิกคิว อย่างกระชั้นชิดเกิน 3 ครั้ง นักวาดจะขออนุญาตไม่รับงานผู้ว่าจ้างอีกในครั้งต่อไป
● หากนักวาดมีความจำเป็นต้องยกเลิกคิวก่อนที่ผู้ว่าจ้างจะชำระเงิน ผู้ว่าจ้างจะได้รับส่วนลดคอมมิชชั่น 10% เมื่อต้องการว่าจ้างในครั้งต่อไป
● หากนักวาดมีความจำเป็นต้องยกเลิกคิวหลังจากผู้ว่าจ้างชำระเงินแล้ว ผู้ว่าจ้างจะได้รับเงินคืน 100% และได้รับส่วนลดคอมมิชชั่น 10% เมื่อต้องการว่าจ้างในครั้งต่อไป
● หากผู้ว่าจ้างต้องการขอยกเลิกคิวเมื่อเริ่มขั้นตอนร่างงานไปแล้ว ผู้ว่าจ้างได้รับเงินคืน 50% ของราคางานนั้น ๆ

📩หมวดหลังเสร็จงาน● สำหรับงานเชิงพาณิชย์ ผู้ว่าจ้างสามารถดัดแปลงงานได้ตามของเขตที่นักวาดกำหนดเท่านั้น เช่น ใส่ Text , ปรับสีเล็กน้อย , ปรับสีพื้นหลัง เป็นต้น หากต้องการดัดแปลงงานนอกเหนือจากนี้ต้องได้รับอนุญาตจากนักวาดเท่านั้น

● นักวาดจะไม่รับแก้ไขรายละเอียดในภาพเพิ่มเติมหลังจากส่งไฟล์ให้กับผู้ว่าจ้างแล้ว ยกเว้น

            ○ ผู้ว่าจ้างต้องการปรับขนาดไฟล์ เช่น แก้ความหนาสันหนังสือ
            ○ มีคำผิดในภาพ ซึ่งเป็นความผิดพลาดของนักวาดเอง
            กรณีอื่นๆ ผู้ว่าจ้างสามารถสอบถามนักวาดก่อนได้● ไฟล์งานจะถูกลบออกจากเครื่องของนักวาดภายใน 5 เดือนหลังจากส่งไฟล์ให้ผู้ว่าจ้างแล้ว เพราะฉะนั้นผู้ว่าจ้างควรเซฟไฟล์งานไว้กับตัวทันทีที่ได้รับไฟล์

🚫หมวดข้อห้าม● ห้ามผู้ว่าจ้างแอบอ้างว่างานที่ได้รับเป็นงานที่วาดด้วยตัวเองหรือวาดโดยคนอื่นนอกเหนือจากนักวาดที่ว่าจ้าง
● ห้ามนำงานที่ได้รับไปอัพโหลดลง A.I. Generator เพื่อดัดแปลงไม่ว่าจะเป็นงานส่วนตัวหรือเชิงพาณิชย์ก็ตาม
● ห้ามนำงานไปลงขาย NFT ไม่ว่าจะเป็นงานส่วนหรือเชิงพาณิชย์ก็ตาม
● ห้ามผู้ว่าจ้างนำงานที่จ้างด้วยเรทราคาส่วนตัว ไปใช้ในเชิงพาณิชย์โดยไม่แจ้งนักวาดก่อน

📌Personal use● The following categories are considered Personal Use:            ○ Gifts: Digital art files intended as gifts for others.
            ○ Non-Promotional Giveaways: Items created for distribution at events such as concerts or Fancafes, provided they are not used to promote a commercial project.
            ○ Personal Collectibles: Artwork used to manufacture items for personal use only (not for sale or profit), such as acrylic keychains or standees.● The client is permitted to reproduce or modify the artwork for non-commercial purposes. For example, adding text/fonts to the image to print as postcards for friends.● If the client does not wish for the artwork to be used as a portfolio sample or display piece, please inform the artist before the work begins.● The client is not required to credit the artist every time the work is posted in public spaces. However, it is strictly prohibited to claim that the artwork was created by the client or any other individual.The copyright of the artwork remains with the artist. The client may not use the artwork for commercial purposes unless an additional fee is paid for a full copyright buyout or a commercial license.

📌Commercial use● The following categories are considered Commercial Use:            ○ Promotional Illustrations: Any artwork used to promote work on online or offline platforms is classified as commercial use, regardless of whether it generates direct revenue. This includes, but is not limited to:
                        - Online/Physical novel or Fanfiction covers.
                        - Fanart for Vtubers.
                        - Promotional images or giveaway items for Fancafes (in cases where the organizer is the client).
                        - Character art or related assets connected to the client's commercial projects.(For other cases, please consult the artist for clarification.)
            ○ Promotional Giveaways: Items produced for the purpose of promoting projects on online or offline platforms.
            ○ Merchandise for Direct Profit: Any artwork used to manufacture products for sale, such as acrylic keychains or standees.● The client must provide full details regarding the intended use of the artwork before the final price is agreed upon. If it is discovered later that the work has been used for commercial purposes without prior disclosure, the client will be required to pay the difference based on the artist's commercial rate.● The client is permitted to reproduce or modify the artwork for commercial use and profit.● Novel Covers and Bonuses: If the commission is for a novel cover, there is no additional charge for using the same image to create "bonus giveaway items" included with the book.● Novel Covers and Additional Merchandise for Sale: If the artwork is commissioned as a novel cover but the client also intends to sell additional merchandise using that same image, an additional fee of 80% of the original image price per item type will apply.            Example: If the novel cover price is 200 USD and you wish to sell acrylic standees and keychains:            Standee: 200 × 80% = 160 USD
            Keychain: 200 × 80% = 160 USD
            Total additional payment: 320 USD● The client is not required to credit the artist every time the work is posted publicly. However, claiming the artwork as your own creation is strictly prohibited.Copyright of the final artwork will be transferred to the client. The artist may only use the work in their portfolio or as a commission sample with the client's explicit permission.*For any cases not covered above, please contact the artist directly for further discussion and clarification.

📃BOOKING SECTION● Max. 2 consecutive slots per person. Each slot is limited to 1 brief.
● After you submit the brief, I will email you the start date, price, and payment deadline. You may request adjustments to the brief or start date at this stage. I will provide updated schedules or quotes until we reach a mutually agreeable agreement.
● If there is no response to the email within 5 days, the booking will be automatically canceled without prior notice.


📝STARTING WORK● Payment MUST be made by the specified deadline; otherwise, the slot will be canceled without prior notice. You may choose to pay a deposit (as agreed, only for those having Thai Bank Account) or the full amount at your convenience.
● If you wish to completely change the brief while waiting for your slot, please submit the new brief at least 2 weeks before the scheduled start date. This allows me to recalculate the price (the original payment deadline still applies).
● To postpone or reschedule your start date, please notify me at least 2 weeks in advance to find a new suitable time.

📝REVISIONS● 3 free revisions are allowed during the sketching/drafting stage. Subsequent revisions will incur a fee of 100 THB per request. Additional fees must be settled before the final files are delivered.

● Any changes to the composition or elements that affect the originally agreed-upon price will result in additional charges (based on complexity). These must be paid before the final delivery.
● In the event of an artist error (e.g., missed brief details), the correction will be made free of charge and will not count toward your revision limit.

❌CANCELLATION● Cancellations made at least 2 weeks before the start date are free of charge.
● If you cancel with less than 2 weeks' notice, a cancellation fee of 10% of the total price will be charged.
● I reserve the right to decline future commissions if there are more than 3 last-minute rescheduling or cancellation requests.
● In the event that I (the artist) must cancel the slot before payment is made, you will receive a 10% discount on your next commission.
● If I must cancel after payment has been made, you will receive a 100% refund plus a 10% discount on your next commission.
● If you choose to cancel after the sketching phase has already begun, a 50% refund of the total price will be issued.

📩AFTER WORK● There will be NO MORE EDITS after the files are sent out EXCEPT FOR :

            ○ Trivial change to the size. (e.g. size of the book spine)
            ○ Typos
            Beside the case above, please discuss with the artist● The files will be removed from the artist's database 5 months after the files are sent out, so the clients MUST make sure that all necessary files are saved as soon as they get them.

🚫MUST NOT● DO NOT claim that the artwork is entirely created by someone else other than the artist.
● DO NOT use the files with A.I. generator to modify the artwork.
● DO NOT trade the files as NFT
● DO NOT use personal artwork for commercial purpose without the artist's permission and extra charge.
